Q: is this the same as a hi hat?

No its not the same. They are a lot smaller than hi-hats and high hats usually have a thinner top cymbal. Could you use it as a hi-hat? Probably, but the sound would be trashy. They sound awful.

Q: Does this need a stand or can I lay it on a surface to play?

Playing laying on a surface would provide no cymbal sound quality. A stand of some sort or cymbal stand is required.
