| Warranty Description | The equipment offered hereby is warranted to be free from defects in material and workmanship at the time of its shipment from the point of manufacture for a period of 365 days from the original date of purchase. Aqua Tally will repair or replace any part of the equipment that fails to conform to this warranty, for a period of one year from the original date of purchase. The original purchaser must promptly return any component(s) needing repair to Aqua Tally, together with proof of purchase. The component(s) should be shipped properly packed, insured, with prepaid postage, to: Aqua Tally, 108 Wyncrest Court, Hendersonville, TN 37075. No warranty of any kind is made, or shall be imposed, with respect to products that have been subject to misuse, negligence, or accident; or have been altered or repaired by anyone other than the original manufacturer. Purchaser’s acceptance of product shall confirm the purchaser’s review and agreement to be bound by this warranty solely. No other written or oral warranty of the product shall be enforceable by the purchaser. Correction of non-conformities, whether patent or latent, in the manner and within the period of time provided above, shall constitute fulfillment of all liabilities of Aqua Tally whether based on contract, tort, strict liability or other legal theory with respect to Aqua Tally products. Aqua Tally neither assumes, nor does it authorize any other person to assume on its behalf, any other liability in connection with the sale of its products. No guarantees, express or implied, other than herein stated or issued in writing by an authorized employee of Aqua Tally shall for any purpose be binding upon Aqua Tally. If any clause or provision of this warranty is illegal, invalid or unenforceable under present or future laws affected during the term of this warranty, then, in that event, the remainder of this warranty shall not be affected thereby. |
